{1} This case arises from a dispute over an indemnification clause in a contract between the City of Albuquerque and BPLW Architects & Engineers, Inc. (BPLW) for the design and construction of the rental car facility at the Albuquerque International Airport. After a pedestrian was injured at the facility, the City requested a defense from BPLW pursuant to the indemnification clause. BPLW denied the request, and the City filed a claim against BPLW. The district court granted partial summary judgment in the Citys favor, finding that BPLW was required to defend the City in the lawsuit brought by the pedestrian because the claim arose from BPLWs design and construction of the facility. BPLW appeals. We affirm.
